Terms of Use

1. Eligibility

1.1 You must be at least 18 years of age to access or use the Platform.

1.2 You must be a resident of a US state or territory where Westarion's services are available. Services are not available in all states. You are responsible for confirming availability in your jurisdiction before creating an account.

1.3 You must complete identity verification through the Company's AML/KYC process before accessing any exchange or wallet functionality. Submission of false or misleading information during verification constitutes grounds for immediate account termination and may be reported to law enforcement.

1.4 Entities that are subject to OFAC sanctions, or individuals acting on behalf of sanctioned parties, are prohibited from accessing the Platform.

2. Account Registration and Security

2.1 You are responsible for maintaining the confidentiality of your account credentials. You agree to notify Westarion immediately upon discovering unauthorized access to your account.

2.2 Each person may hold only one account. Creating multiple accounts to circumvent transaction limits, access tiers, or compliance reviews is prohibited.

2.3 You are responsible for all activity conducted through your account. Westarion is not liable for losses resulting from unauthorized account access where you have failed to maintain credential security.

3. Platform Services

3.1 The Platform provides access to a cryptocurrency exchange and a self-custody software wallet for supported digital assets. The specific assets and functions available to your account depend on your verified access tier and jurisdiction.

3.2 The exchange facilitates buying and selling of digital assets at market rates. All applicable fees are disclosed before order confirmation. By confirming an order, you agree to the displayed fee structure.

3.3 The self-custody wallet is software that enables you to generate and store private keys on your own device. Westarion does not custody your private keys and cannot recover lost keys or restore access to self-custody wallets. You are solely responsible for the security of your private keys.

3.4 Westarion reserves the right to suspend, modify, or discontinue any aspect of the Platform at any time with or without notice, including restricting access to specific assets or features based on regulatory developments.

4. Prohibited Conduct

You agree not to:

4.1 Use the Platform for any unlawful purpose or in violation of applicable federal, state, or local law.

4.2 Attempt to circumvent, disable, or interfere with the Platform's security features, AML/KYC systems, or transaction monitoring.

4.3 Use the Platform to engage in money laundering, terrorist financing, fraud, market manipulation, or any other financial crime.

4.4 Provide false, misleading, or fraudulent information during account creation or verification.

4.5 Reverse engineer, decompile, or attempt to extract source code from any software component of the Platform.

5. Risk Acknowledgment

5.1 You acknowledge that cryptocurrency involves substantial risk of loss. Digital asset values fluctuate significantly and may go to zero.

5.2 Accounts and assets held through the Platform are not FDIC insured, not bank guaranteed, and not covered by any government deposit protection program.

5.3 Past performance of any digital asset is not indicative of future results. Nothing on this Platform constitutes investment advice, financial advice, or a recommendation to buy, sell, or hold any digital asset.

5.4 You are solely responsible for your own investment and trading decisions. Westarion is not responsible for any loss resulting from decisions made based on information provided on the Platform.

6. Fees and Payments

6.1 All applicable fees are disclosed before transaction confirmation. By confirming any transaction, you agree to pay the stated fees.

6.2 The Company reserves the right to modify its fee schedule. Changes will be communicated with advance notice through the Platform or registered email address.

6.3 All transactions are final upon confirmation unless an error resolution process is applicable as described in the Compliance section.

7. Intellectual Property

7.1 All content, software, trademarks, logos, and materials on the Platform are owned by Ethio American LLC or its licensors. Nothing in these Terms grants you any license to use Westarion's intellectual property.

7.2 You may access the Platform solely for your own personal, non-commercial use. Reproduction, distribution, or commercial use of any Platform content requires prior written consent.

8. Disclaimers

8.1 The Platform is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure at all times.

8.2 We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

9. Limitation of Liability

9.1 To the maximum extent permitted by applicable law, Ethio American LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

9.2 Our total liability for any claim arising from your use of the Platform shall not exceed the fees paid by you to Westarion in the three months preceding the claim.

10. Governing Law and Disputes

10.1 These Terms are governed by the laws of the State of Texas without regard to conflict of law provisions.

10.2 Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the American Arbitration Association Commercial Arbitration Rules, conducted in Fort Worth, Texas, unless applicable law prohibits arbitration for the specific claim type.

10.3 You waive the right to participate in class action litigation or class-wide arbitration for any dispute covered by these Terms.

11. Termination

11.1 Westarion may suspend or terminate your account at any time for violation of these Terms, regulatory requirements, or suspected fraudulent activity, with or without prior notice.

11.2 Upon termination, your right to access the Platform ceases immediately. Provisions related to risk acknowledgment, intellectual property, disclaimers, and limitation of liability survive termination.

12. Modifications to Terms

12.1 We may update these Terms at any time. Material changes will be communicated by posting updated Terms with a revised effective date. Continued use of the Platform after changes take effect constitutes acceptance.
